Abstract
L’émergence des nouveaux modes de règlement des différends, plus spécifiquement celle de la médiation, peut être vue comme un élément de déjudiciarisation des différends. Dans cet article, le rapport entre l’émergence des nouveaux modes de règlement des différends et la transformation de la fonction de juger est analysé à la lumière de la montée du droit administratif comme première étape de déjudiciarisation. La médiation est par la suite examinée en tant que réponse à la procéduralisation de la justice non judiciaire du droit administratif. La médiation est alors posée comme une manière d’assurer une justice non judiciaire et non procédurale, c’est-à-dire une justice informelle.
