Abstract
Le curateur public du Québec a pour mission de protéger dans leurs droits et leurs biens les personnes déclarées inaptes en vertu de la loi. Il s’agit des citoyens les plus démunis de notre société, à un point tel qu’ils sont dans l’incapacité d’exercer leurs droits et doivent se faire représenter par un tiers. Toutefois, protéger et représenter légalement une personne inapte, dans son seul intérêt, dans le respect de ses droits et la sauvegarde de son autonomie, amène le curateur à prendre pour autrui des décisions dont les répercussions sont parfois incommensurables sur le plan éthique. L’enjeu est d’autant plus grave que le citoyen à protéger est toujours dans une situation de faiblesse et de grande vulnérabilité, en raison même de son inaptitude. La croissance appréhendée de ce dernier phénomène, entraînée par le vieillissement de la population au cours des prochaines décennies, constitue un véritable défi pour l’État et exige de lui des réponses appropriées.
