Abstract
Cet article présente les principes directeurs des politiques publiques en matière de drogues et les responsabilités de l’État qui en découlent lorsqu’ils sous-tendent le libéralisme juridique. Pour ce faire, à partir des trois grandes options de politiques publiques soulevées par la commission Le Dain dans son rapport sur Le cannabis, on décrit les valeurs sociales privilégiées dans chacune d’elles. Par la suite, adoptant le point de vue du libéralisme juridique, on présente les responsabilités de l’État qui en résultent pour élaborer une politique sur les drogues fondée sur la santé publique et le respect des citoyens.
