La sagesse désigne un savoir essentiellement pratique, un art de se conduire et une aptitude à bien juger. L’article s’interroge sur la sagesse du juge et sur les limites à son pouvoir d’interprétation. La décision du juge implique un risque et un calcul, elle affirme un choix de politique juridique qui ne peut s’exercer de façon débridée. Contrairement au sage de l’Antiquité qui pratique parfois la suspension du jugement, le juge doit trancher le différend qui lui est soumis. Il doit à la fois dire le droit et rendre la justice. Texte et contexte limitent son pouvoir créateur et le forcent à une certaine sagesse.
