Abstract
Le droit international servirait moins à atteindre les objectifs qu’il se donne explicitement (paix, justice, développement, etc.) qu’à perpétuer une certaine théorie des sujets légitimes des relations internationales, à savoir les Etats. Tout dans le droit international est historiquement secondaire à cet objectif cardinal. En réalité, les évolutions des dernières décennies n’ont que très peu déplacé la centralité juridique (la question sociologique est distincte) des souverains en droit international, malgré les tentatives d’encadrer l’Etat et de redéfinir la souveraineté. Le droit international fait partie intégrante de la construction du monopole de la violence légitime de l’Etat dans l’ordre international; il confère à l’Etat un rôle unique et inégalé dans la gouvernance du droit international; et même ses projets substantifs les plus réformistes semblent réinscrire la centralité de l’Etat à chaque tournant. Il s’agira donc de comprendre en quoi consiste l’étatisme spécifique du droit international, c’est-à-dire un étatisme de reproduction des formes malgré le changement des buts. On conclura avec quelques réflexions sur la difficulté d’une réforme fondamentale d’un système normative dont la vocation principale est la perpétuation d’un certain ordre de puissance.
