Análisis crítico de la Sentencia Nadege Dorzema y otros vs República Dominicana dictada en octubre de 2012 por la CorteIDH, el cual constituye un caso emblemático en la región sobre estándares de debido proceso de ley en materia de migración, como continuación de la evolución jurisprudencial del caso Vélez Loor vs Panamá de 2010. Además de que por primera vez expresamente se indica que las deportaciones colectivas son prohibidas, se identifican los estándares identificados por la CorteIDH en su evolución jurisprudencial en el tema, al tiempo que se proponen otros estándares respecto a los cuales el tribunal internacional debiera pronunciarse en un próximo caso. Nadege Dorzema y otros se enmarca en un contexto de discriminación a migrantes haitianos y sus descendientes, lo que da lugar a un concepto por primera vez desarrollado por el tribunal internacional de “discriminación indirecta” y a la discusión del fardo de la prueba del contexto de discriminación en un Estado. Al respecto, proponemos el establecimiento del concepto de discriminación estructural conforme características como el presente caso y antecedentes jurisprudenciales de la CorteIDH. Asimismo, se identifican puntos relevantes en el procedimiento ante la CorteIDH sobre la identificación de víctimas, uso de la fuerza y reparaciones.
