Le présent article vise à sensibiliser les juristes à une réflexion épistémologique autour des concepts de droit cosmopolitique et de droit global . Ces concepts nous semblent aujourd’hui trop souvent négligés et, dans la perspective de leur redonner leur place, délaissant volontairement l’approche juridique « classique », nous lui préfèrerons une démarche scientifique en trois étapes. Tout d’abord, nous opérerons une rupture nette avec l’illusion juridique qui résulte essentiellement du positivisme juridique et du nationalisme méthodologique. Ensuite, nous présenterons la construction théorique du droit cosmopolitique à travers sa genèse et son actualisation. Enfin, nous constaterons, de manière empirique, que la notion émergente de droit administratif global présente un profond lien de filiation avec celle de droit cosmopolitique.
