Abstract
La dette écologique est un concept politique qui vise à faire reconnaître la nocivité des modes de production et de consommation fondés sur l’extraction de ressources naturelles et leur échange dans le cadre d’une économie de marché. On la réduit souvent à la responsabilité financière qui en découlerait pour les États industrialisés. Pourtant, ceci ne correspond qu’à un versant de la dette écologique. Si réparer est une fonction fondamentale du droit, celui-ci doit aussi pouvoir énoncer des règles positives, en l’occurrence quant à la gestion soutenable des ressources naturelles. Cet article présente les différentes approches de la dette écologique puis met en exergue son versant constituant au travers de normes primaires représentatives d’une logique de la dette écologique.
