El 11 de septiembre de 2001 marcó el final del período de la post-guerra fría, y el surgir de una nueva era en las relaciones internacionales. Ésta se ha visto profundamente marcada en su desarrollo por el influjo del primer “interregno neoconservador” del siglo XXI en la política exterior estadounidense. En contraste con la presentación alarmista que suele dársele a la posición de hegemonía del neoconservadurismo en la doctrina jurídica internacional, este estudio indaga en las raíces de la aversión manifiesta del neoconservadurismo estadounidense ante el orden jurídico internacional contemporáneo. A fin de destacar las raíces de esta postura defensiva, se presentan, en primer término, cuatro ejes de coordenadas de un modelo básico de interpretación motivacional de la acritud demostrada por el pensamiento neoconservador ante el derecho internacional. Se procede, en segundo lugar, a indagar en los medios que adopta la efectiva implementación de la estrategia ofensiva adoptada por los juristas neoconservadores al respecto, cotejando, para ello, el pensamiento jurídico neoconservador con las corrientes negadoras del derecho internacional. Se argumenta en tercera instancia, sobre el plausible acercamiento conceptual de la perspectiva neoconservadora del derecho internacional con la “ciencia jurídica orientada a la ciencia de la política jurídica” del derecho internacional de la Escuela de New Haven . El estudio concluye destacando ciertas similitudes doctrinales entre el pensamiento jurídico internacional neoconservador y la agenda normativa subyacente a otras corrientes jurídicas internacionales, e invitando al desarrollo de una más amplia agenda de investigación doctrinal en ese sentido.
