Si l’oeuvre normative accomplie par la Cour européenne des droits de l’Homme est relativement bien connue, le statut et les conditions de travail de ses membres le sont beaucoup moins. Des questions pourtant essentielles y sont liées, telles que les garanties d’indépendance et de représentativité propres à toute juridiction internationale. Or, ces exigences sont les conditions mêmes de la légitimité de l’institution et donc du succès de son action. Le problème crucial réside alors dans la conciliation entre ces exigences, apparemment contradictoires, de l’indépendance et de la représentativité de la Cour à l’égard des États soumis à sa juridiction. Il convient de relever dans un premier temps que les modalités de la sélection des candidats, futurs juges à la Cour de Strasbourg, viennent assurer la représentativité de la Cour, puisque chaque État soumis à sa juridiction présente une liste de candidats, dont l’un au moins occupera un poste de juge. D’autre part, l’exigence d’indépendance sera mise en oeuvre dès cette étape initiale (les candidats étant élus pour leur compétences juridiques et non en qualité d’agents du gouvernement) mais encore et surtout par la suite. En effet, diverses dispositions de la Convention européenne des droits de l’Homme, et du Règlement intérieur de la Cour, ont été imaginées afin de garantir efficacement l’indépendance, individuelle et collective, des juges pendant leurs fonctions. On pourrait ainsi relever le régime des immunités et privilèges bénéficiant aux juges, les sanctions de toute incompatibilité avec la fonction juridictionnelle européenne ou encore l’autonomie fonctionnelle de la Cour comme autant de garanties efficaces de son indépendance.
