Abstract
Les compagnies militaires privées font de plus en plus parler d’elles. Malgré le rôle important joué par ces compagnies dans les conflits armés depuis le début des années quatre-vingt-dix, leur statut de même que l’étendue et les limites du rôle qu’elles peuvent jouer demeurent ambigus au regard du droit international. La présence d’acteurs privés capables de changer l’issue de conflits indépendamment de la volonté étatique, voire pour des intérêts privés, de même que l’accroissement d’une certaine dépendance des États envers l’entreprise privée pour l’exécution de fonctions qui leur sont aussi fondamentales que le domaine militaire, semble menacer, ou à tout le moins transformer, les règles traditionnelles relatives à la conduite et au règlement des conflits armés. Cet article explorera succinctement le phénomène des compagnies militaires privées et tentera d’établir des pistes de réflexion quant à leur statut et aux conséquences de leurs activités sur l’ordre juridique international.
