En 2010, la compagnie américaine AbitibiBowater a porté plainte contre le Canada en vertu du chapitre 11 de l’Accord de libre-échange nord-américain (ALÉNA), alléguant l’expropriation de son investissement par la province de Terre-Neuve-et-Labrador. Défendeur dans cette affaire, le gouvernement du Canada a choisi de régler avec l’investisseur américain au coût de 130 millions de dollars canadiens. Par la suite, le premier ministre Harper a indiqué que son gouvernement ne tenterait pas de recouvrer l’argent de la province, mais qu’il envisageait de mettre en place un mécanisme qui pourrait le permettre à l’avenir. Plus de cinq ans plus tard, aucun tel mécanisme n’a été établi. Cet article explore les obstacles constitutionnels au recouvrement forcé des dommages versés par le gouvernement fédéral qui pourraient expliquer ce manque d’action. Que ce soit en vertu du pouvoir de dépenser (ou de ne pas dépenser), de chefs de compétences spécifiques ou du pouvoir résiduel, aucune piste de solution ne semble échapper aux réalités constitutionnelles canadiennes. En particulier, l’empiètement sur les compétences provinciales pose problème. Les obstacles constitutionnels mènent l’auteure à explorer des solutions d’avenir, de nature conventionnelle (c’est-à-dire à même les accords commerciaux dits de « deuxième génération ») et administrative (c’est-à-dire au moyen d’un accord fédéro-provincial). Le partage de la responsabilité financière entre l’Union européenne et ses 28 États membres dans ce contexte est étudié afin d’en tirer des leçons. En conclusion, l’auteure estime que, du point de vue juridique, la piste de solution la plus prometteuse se trouve dans les accords administratifs, mais que les obstacles politiques ne doivent pas être sous-estimés.
