Malgré la brièveté de son énoncé, l’article 1 commun aux Conventions de Genève et à leurs Protocoles additionnels révèle quelques-uns des aspects fondamentaux du droit international humanitaire ainsi que certaines incertitudes majeures quant à sa situation actuelle. Le premier pan des obligations énoncées par l’article 1 commun, soit celle de respecter le droit humanitaire en toutes circonstances éclaire le caractère erga omnes des obligations du droit humanitaire. Celles-ci sont dues à la communauté internationale dans son ensemble et chaque État est, par suite, titulaire du droit de les faire respecter. L’obligation de faire respecter va au-delà et impose à chaque État de veiller au respect du droit humanitaire par les autres États. La présente étude, qui s’inscrit dans un cadre d’analyse opposant droit de coexistence et droit de coopération, pose la question suivante : l’obligation de faire respecter le droit humanitaire est-elle révélatrice de l’existence d’un droit international humanitaire de coopération ? Une esquisse de réponse montre les difficultés à dépasser le cadre du droit de coexistence pour entrer dans le champ du droit de coopération.
