Abstract
Le droit naturel reste très actuel en droit international. Il n’est pas « à nouveau » d’actualité, il demeure d’actualité. C’est-à-dire que le droit international aujourd’hui continue à se penser et à se dire selon les termes du droit naturel. Cette contribution tentera dans un premier temps d’éclaircir le lien entre volontarisme et jusnaturalisme, avant de montrer en quoi cet autre discours du droit naturel que sont les droits de l’Homme vient déconstruire le discours du volontarisme en droit international. Enfin, elle cherchera dans quelle mesure les droits de l’Homme sont à leur tour mis en cause, toujours au nom du droit naturel, ou plus exactement au nom de la nature, mais cette fois par un discours qui se situe à la conjonction du droit naturel des Anciens et du droit postmoderne.
