Abstract
La Cour de justice des Communautés européennes (CJCE) a renversé la jurisprudence du Tribunal de première instance des Communautés européennes (TPICE) en matière d’applicabilité des résolutions du Conseil de sécurité de l’Organisation des Nations unies (ONU) et du contrôle de la légalité des mesures prises en leur application par les cours de l’Union européenne en vertu des droits de la personne. La jurisprudence en question clarifie certains aspects importants du droit par rapport auxquels il y avait de la controverse ou de l’ambiguïté. Le présent article fait le point sur le droit en vigueur relatif au rapport entre le droit international public et le droit communautaire. Il analyse l’existence de différents standards de protection des droits fondamentaux dans les cours européennes et il s’interroge sur les responsabilités respectives des organisations internationales et sur leur autonomie dans la lutte contre le terrorisme.
