Cette étude propose une réflexion sur le mécanisme de réparation prévu par le Statut de Rome de la Cour pénale internationale. Dix ans après sa création, la Cour a rendu son premier jugement dans l’affaire Lubanga. En mars 2012, la Chambre de première instance a déclaré l’accusé coupable de crimes de guerre. Elle a invité les parties et les participants à soumettre leurs observations sur les principes qu’elle devrait appliquer pour fixer la réparation et sur la procédure à suivre. La phase des réparations est imminente. À la lumière des expériences des instances ad hoc pour l’ex-Yougoslavie et le Rwanda et à celle des Chambres extraordinaires au sein des tribunaux cambodgiens, l’auteure situe la place des victimes dans le procès pénal international (I). Elle analyse des notions complexes du droit substantiel du Statut de Rome, notamment celles des bénéficiaires et des débiteurs de la réparation, des principes applicables, des formes de réparation admises et du caractère individuel et/ou collectif de l’ordonnance de réparation (II). Elle procède ensuite à l’examen des questions liées à la procédure et à l’administration de la preuve (III). L’auteure conclut son étude en abordant les enjeux de la mise en oeuvre de la réparation et le rôle important que le Fonds au profit des victimes pourrait jouer à cette étape décisive (IV).
