Abstract
Le choix des contrats internationaux de bioprospection, cumulé avec le modèle de l’économie de marché capitaliste comme moyen de mise en oeuvre des objectifs de la Convention sur la diversité biologique en matière de conservation de la biodiversité et de partage des avantages, s’avère à plusieurs égards périlleux pour les acteurs du Sud, notamment les communautés locales et autochtones. En pratique, en raison du déséquilibre flagrant des rapports de force entre parties, ces contrats peuvent être aisément instrumentalisés par la partie la plus puissante pour devenir un support de biopiraterie lorsque les conditions de la Convention sur la diversité biologique en matière de consentement préalable et de partage des avantages ne sont pas respectées. Dans tous les cas, ces contrats ne pourront pas garantir une protection suffisante des savoirs traditionnels contre la biopiraterie ni constituer une alternative fiable à un système multilatéral obligatoire comme celui défendu aujourd’hui par les pays du Sud dans le cadre des travaux du Conseil de l’Accord sur les aspects des droits de propriété intellectuelle qui touchent au commerce (ADPIC) portant sur le réexamen de l’ Accord sur les ADPIC de l’OMC.
