Cet article a comme objectif de proposer une grille théorique interprétant l’évolution des règles et de la pratique du droit international à partir de certaines contraintes systémiques et d’aléas conjoncturels du mode de production capitaliste. Plus particulièrement, notre argument sera le suivant : dans Le Capital , Marx a bien mis en relief que la raison d’être du mode de production capitaliste était la création de profits pour la classe capitaliste. Or l’une de ses thèses les plus controversées est celle que Marx appelle la « loi de la baisse tendancielle du taux de profit » qui, à cause de la modification historique de la composition organique du capital, a comme effet d’amener « tendanciellement » ces taux de profit à un niveau insuffisant pour garantir l’accumulation du capital et la survie du capitalisme. Cette loi, cependant, est contrebalancée par des « influences contraires » qui, elles, ont plutôt l’effet inverse de hausser ces taux et de les garder à un niveau suffisant pour assurer la survie du capitalisme. Si la loi est sujette à controverses et ne sera pas retenue dans cet article, ce sont toutefois les influences contraires qui vont constituer le coeur du cadre conceptuel de cet article. Plus particulièrement, celui-ci proposera de séparer la période de l’après-guerre en quatre sous-périodes qui se caractérisent notamment par des taux de profit moyens différents au niveau international, puis de proposer une interprétation historique de par laquelle nous mettrons en parallèle et analyserons l’interrelation entre deux trames historiques différentes (l’évolution des taux de profits et celle du droit international). Nous chercherons notamment à voir si le droit international a été influencé par l’évolution des taux de profit de façon à faire en sorte qu’il a créé des institutions ou engendré des pratiques ayant comme objectif de favoriser les influences contraires à la baisse du taux de profit.
