Abstract
Promulguées à la même époque, la Déclaration universelle des droits de l’Homme et la Déclaration américaine des droits et devoirs de l’homme , ont chacune eu une évolution différente. Alors que le cinquantenaire de la première a été largement souligné, celui de la seconde s’est fait plus discret. Pourtant, la Déclaration américaine s’est imposée à tous les États membres de l’Organisation des États américains de manière exceptionnelle. De plus, loin d’être éclipsée par l’adoption de la Convention américaine relative aux droits de l’homme , son autorité a plutôt été renforcée. L’article de Carol Hilling souligne le rôle de la Commission interaméricaine des Droits de l’Homme dans l’évolution du statut juridique de la Déclaration américaine . L’article fait également état de la portée tout à fait particulière du système interaméricain de protection des droits de la personne qui offre même au Canada la possibilité d’obtenir des réponses à ses interrogations concernant la Convention américaine avant de la ratifier.
