En mars 2013, un nouveau chapitre s’est ouvert dans l’histoire du Guatemala avec le début du procès à l’encontre de l’ancien chef d’État, le général Efrain Ríos Montt. Formellement inculpé de génocide et de crimes contre l’humanité, ce dernier est accusé d’avoir commis des violations envers la population maya pendant son règne entre 1982 et 1983. Jusqu’à tout récemment, le Guatemala faisait partie des États latino-américains n’ayant pas encore ratifié le Statut de Rome. Pourtant, avec plus de 200 000 victimes de 1960 à 1996 et ce, malgré les conclusions du rapport de la Commission de clarification historique (CEH) en 1999, les principaux responsables suspectés d’atrocités commises durant le conflit armé au Guatemala n’avaient jamais été traduits en justice. Or, la période post-conflit au Guatemala s’est caractérisée par une méfiance généralisée envers les institutions politiques et judiciaires, ainsi que par la pérennisation de l’impunité. Comment expliquer ce changement de cap opéré par le nouveau président guatémaltèque, Otto Pérez Molina, lui-même ancien militaire soupçonné de violations de droits humains ? Cet article cherche à illustrer le rôle novateur de la Commission internationale contre l’impunité au Guatemala (CICIG) parmi les différentes interventions internationales depuis la fin du conflit armé, de même que sa complémentarité avec le travail de la Cour pénale internationale (CPI). Nous concluons que les avancées de la CICIG ont favorisé un changement dans la culture politique guatémaltèque, une condition sine qua non en vue d’éventuelles poursuites d’anciens militaires. Les récents évènements politico-juridiques, survenus entre 2012 et 2013, semblent appuyer notre hypothèse.
