Abstract
Le processus d’intégration régionale a pour effet de modifier profondément l’environnement économique dans lequel évolue le consommateur. La priorité accordée à la libre circulation des produits et des services à l’intérieur du marché régional risque de conduire au démantèlement des mesures nationales de protection des consommateurs tenues comme constitutives d’entraves au libre-échange. Le maintien, voire le renforcement, du niveau de protection reconnu aux consommateurs dans les États membres de la région passe donc par des initiatives régionales. La protection du consommateur peut être élevée au rang d’une exception légitime, sous certaines conditions, à l’application des règles de l’accord régional relatives au libre-échange. Mieux encore, l’accord d’intégration régionale peut confirmer le besoin d’une véritable politique régionale de la protection du consommateur et se doter des instruments à cette fin. L’objet du présent article est de comparer et d’évaluer les approches adoptées par les principaux accords régionaux en vigueur dans les Amériques et en Europe à l’égard de la politique de protection du consommateur.
