La gestion des déchets radioactifs, comme le reste de la normativité nucléaire, fait l’objet d’un cadre juridique international et national et est composée de normes conventionnelles et de soft law . Le cas de Sellafield, site d’une usine MOX, en Angleterre, est analysé dans un contexte national et international. En effet, un parcours interne démontre des différences de perception par les tribunaux britanniques des différents points en litige et notamment de la perception du risque technologique et l’information nécessaire afin de faire un choix sociétal d’une technologique comportant des risques. Dans un cadre international qui comporte des facettes du droit de la mer ainsi que du droit international de l’environnement, les décisions rendues nous portent à arriver à la même conclusion. On constate que les questions fondamentales rattachées au risque technologique et les conclusions apportées par les différentes instances judiciaires au niveaux interne et international nous portent à croire qu’il existe une véritable Cour de Babel où plusieurs langages juridiques sont parlés mais sans toutefois pouvoir définir un langage commun et compréhensible.
