L’apparition des standards comme source du droit international traduit une normativité internationale porteuse de technicité. Cet article montre que le standard, d’un point de vue diachronique, est soit un instrument de mesure de comportements sociaux corrects, soit un outil de tracé d’une grande précision. La standardisation internationale semble, d’un point de vue purement formel, rétrécir considérablement la frontière classique entre le droit et le non-droit. Eu égard à l’éclatement et à la nouvelle structuration de la société internationale, les sources traditionnelles du droit (le traité ou la coutume), même si elles demeurent essentielles dans la régulation des rapports internationaux, sont de plus en plus inadaptées aux nouvelles exigences de rapidité, de souplesse et d’adaptabilité que nécessite la coopération internationale. La réalité internationale actuelle, caractérisée par l’extraordinaire développement de la technoscience, exige que les degrés de juridicité de la règle ou de la norme de droit international varient en fonction des besoins et que l’obligatoriété ne soit plus le seul fondement de la règle de droit. Le standard international caractérise cette tendance de juridicisation de la technicité. Dans un contexte où l’édifice normatif est de plus en plus variable, l’article montre que le standard est une espèce particulière de règle de droit qui traduit la normativité en termes de normalité; normalité quant à ce qui est (standard-mesure) et normalisation quant à ce devrait être (standard-tracé). Il examine au passage la place du juge dans l’objectivation du contenu normatif du standard-mesure.
