Abstract
La Convention des Nations unies sur le droit de la mer (CNUDM) octroie aux États côtiers de nombreux droits et responsabilités dans les eaux adjacentes à leur territoire. Pour assurer le respect de ces normes, un droit de poursuite a été prévu. Ce droit de poursuite, datant de plusieurs centaines d’années, a été intégré dans la convention en fonction des technologies de l’époque. Cependant, parmi les critères qui encadrent ce droit, on y retrouve deux obligations problématiques : l’obligation de signaler le début de la poursuite et l’obligation du caractère continu de la poursuite. De plus, les dispositions relatives à ces obligations sont rédigées de telle sorte qu’intégrer l’usage de nouvelles technologies est presque impossible. Donc, la pertinence de ce droit de poursuite dépend de sa capacité d’adaptation. C’est pourquoi une interprétation large ou une modification des dispositions pertinentes de la CNUDM est nécessaire.
