Abstract
La résolution 61/295 portant Déclaration des Nations unies sur les droits des peuples autochtones peut être analysée à la lumière de l’engagement des États tant du point de vue de l’ instrumentum de l’acte que de son negotium. Les États membres de l’ONU se trouvent engagés formellement par la résolution 61/295, sur la base du principe de la bonne foi qui leur est opposable. Leur engagement doit traduire une volonté de mettre en oeuvre effectivement la résolution. L’engagement des États à travers la résolution 61/295 se prolonge dans le negotium de l’acte car sa nature est normative. Sur le terrain coutumier, l’engagement des États par le negotium peut se confondre avec des obligations de lex lata ou se limiter à des propositions de lex ferenda .
