Abstract
El sistema de etiquetado-certificación ambiental permite a los consumidores, a los compradores públicos y privados identificar los productos “verdes”. Ello permite demostrar y comunicar a las formas de gestión que su producción y prestación de servicios sea respetuosa con el medioambiente como necesidad social; es a la vez un derecho individual y colectivo, donde todo ser humano tiene el derecho de gozar de un medioambiente adecuado y el deber de conservarlo. Se establece la obligación de los poderes públicos de velar por la utilización racional de los recursos naturales, con el fin de proteger y mejorar la calidad de la vida y defender y restaurar el medioambiente. El objetivo del sistema de concesión de etiqueta ecológica es reducir el impacto negativo de la producción y el consumo sobre el medioambiente, la salud, el clima y los recursos naturales, promoviendo productos que tengan un nivel elevado de comportamiento ambiental mediante la utilización de la etiqueta. El artículo muestra las insuficiencias dentro de la ordenación jurídica nacional para la concesión de la etiqueta-certificación ambiental, entregada de forma mayoritaria a las formas de gestión del sector estatal al ser este el sector mayoritario en el comercio cubano. Para ello fueron empleados métodos de investigación como el teórico-jurídico, el histórico-lógico, el exegético-jurídico, el de derecho comparado, y el de análisis y síntesis.
