Abstract
À la faveur des vingt ans du développement durable, il importe de s’interroger sur les moyens d’assurer l’effectivité d’un concept extrêmement populaire dans les moindres recoins du monde, dans la mesure où il entend concilier développement économique, protection de l’environnement et développement social. Le concept reflète une conception équilibrée du développement largement partagée ainsi qu’en attestent par exemple les conférences internationales organisées sous l’égide des Nations Unies depuis 1992. Le souci d’améliorer l’effectivité de cet ambitieux concept pourrait se concrétiser dans une organisation mondiale du développement durable, dont la mission consisterait dans l’adoption de normes internationales, mais aussi et surtout dans le contrôle de leur mise en oeuvre. Façonnée notamment sur le modèle de l’Organisation mondiale du commerce, de la procédure de non-respect de la Convention d’Aarhus et la procédure de non-respect du Protocole de Kyoto, cette nouvelle institution internationale admettrait une large participation de la communauté internationale (dont la société civile) et pourrait connaître des atteintes au droit du développement durable commises tant par les États que par les sociétés multinationales.
