Abstract
La parution en février 2015 de l’ouvrage intitulé L’État du droit administratif permet de renouer en partie, dans le contexte de la France, avec l’analyse critique du droit, notamment par l’étude de dimensions qui relèvent de la surdétermination. Ce qui serait déterminant en dernière instance, au point de surdéterminer une structure dominante comme celle du droit administratif, relève désormais des sciences économiques, des sciences de la gestion et des théories contemporaines de la nouvelle gouvernance publique. Ces dimensions conditionnent désormais la production du droit administratif, au même titre que les figures de l’État managérial. Cet ouvrage introduit ainsi des perspectives qui vont bien au-delà d’un seul modèle national, comme c’est le cas de la France. Dans ce contexte, il est utile de faire une rétrospective des approches critiques du droit administratif en France, la contrepartie étant l’évolution des réflexions sur ce point en monde anglo-américain. L’analyse qui suit montre qu’il est légitime de s’interroger sur ce qui peut être considéré comme de l’analyse critique du droit, et ce, en prenant pour contrepoint l’échec relatif des approches trop externes au droit.
