Abstract

La rencontre du malade mental auteur d'infraction avec le système judiciaire a donné lieu au sein des systèmes occidentaux, à la mise en œuvre de traitements judiciaires inégalitaires allant d'un traitement judiciaire puis pénal indifférencié de l'infraction, à un traitement considérant avec attention le rôle joué par la maladie mentale dans la commission de l'infraction. Le système judiciaire québécois semble avoir fait le choix d'un dispositif favorisant l'évaluation continue de l'auteur, dès son entrée dans le processus judiciaire, notamment par le criminologue dont le rôle central en terme d'évaluation est ici présenté. Le processus présenté constitue un modèle de réflexion pour les professionnels français des champs sanitaire, judiciaire et pénal et offre de nouvelles perspectives de pratiques professionnelles permettant une lecture raisonnée des faits commis par les auteurs malades mentaux, loin d'un traitement politicomédiatique marqué par l'émotion qui semble participer à une stigmatisation continue de cette population.
