Abstract
Lorsqu’il proposait « [u]ne charte des droits de l’homme pour le Québec » en 1963, le professeur Jacques-Yvan Morin contribuait de manière significative à l’édification des bases matérielles et idéologiques de l’éventuelle Charte des droits et libertés de la personne de 1975. Dans son texte de 1963, puis dans celui paru en 1987 dans lequel il a poursuivi sa réflexion sur « [l]a constitutionnalisation progressive de la Charte », le professeur Morin proposa trois idées dont il se fît le précurseur dans le contexte de la Charte québécoise : (1) les libertés individuelles et la justice sociale sont indissociables ; (2) une charte destinée à consacrer solennellement les valeurs fondamentales d’une société doit non seulement garantir des libertés, mais également certains droits économiques et sociaux justiciables ; (3) l’État ne saurait, sans justification raisonnable et compte tenu de son niveau de développement, retirer aux citoyens les droits et les mesures socioéconomiques dont ils bénéficient. Nous défendrons et développerons ci-dessous l’importance et le contenu de ces trois idées eu égard à la Charte québécoise.
