Abstract
En este trabajo se analiza la forma en que distintos ordenamientos juridicos se han pronunciado sobre la validez juridica de un nuevo conjunto de medidas de restriccion del tabaco que pasan por la regulacion de un empaquetado generico, homogeneizado y privado de todo atractivo promocional. Estas medidas han comenzado a debatirse e implantarse de forma reciente en paises como Australia, Estados Unidos, Canada, Reino Unido o Francia y tambien han sido consideradas, aunque descartadas de momento, por la Union Europea con ocasion de la Directiva 2014/40. En la cuestion se entremezclan importantes aspectos de marketing, economia, regulacion mercantil del derecho de marcas y tratados de comercio internacional. El pujante lobby tabaquero pone tambien en duda la relevancia misma de la medida en terminos de salud publica, autodeterminacion personal y control del propio producto. Sin perder de vista toda esta problematica, aqui se adopta una perspectiva juridico-publica, y en particular administrativa, prestando especial atencion a los argumentos del debate relacionados con el potencial caracter expropiatorio de la medida y a la incidencia sobre derechos como la libertad de expresion o de empresa.
