Le 21 juillet 2010, le président des États-Unis d’Amérique a promulgué le Dodd-Frank Wall Street Reform and Consumer Protection Act relativement aux marchés financiers dans ce pays. Certaines dispositions de cette loi produisent des effets en République démocratique du Congo (ci-après « RDC »), en l’occurrence l’article 1502 intitulé « Conflict Minerals ». La présente contribution en examine la licéité en droit international au regard du principe de la souveraineté des États et de la notion de « domaine réservé ». Elle montre que l’article 1502 semble tenir compte du rôle de la RDC dans la gouvernance de ses ressources naturelles, mais s’interroge sur le fait de savoir si un conflit est possible entre, d’une part, les pouvoirs que cet article attribue aux autorités américaines dans la lutte contre les minerais liés aux conflits et, d’autre part, les compétences que la RDC doit exercer sur ses ressources naturelles et sur les activités économiques se déroulant sur son territoire. Elle prévient enfin qu’avec la question des minerais du conflit se profile le risque, pour la RDC, de voir la gestion de ses ressources naturelles internationalisée.
