ACESSIBILIDADE E MÍDIAS EDUCACIONAIS DIGITAIS: UMA REVISÃO DOS MARCOS LEGAIS INTERNACIONAIS E NACIONAIS E SUA APLICAÇÃO NAS INSTITUIÇÕES PÚBLICAS DE ENSINO SUPERIOR (IFES)

Abstract
Este artigo traz uma revisão dos marcos legais internacionais e nacionais sobre a acessibilidade na elaboração das mídias educacionais digitais pelas instituições públicas de ensino superior (IFES). O objetivo é realizar uma compilação dos principais diplomas normativos e demais documentos importantes que regem as questões de acessibilidade com relação às mídias educacionais digitais, de forma a contribuir com os estudos sobre o tema e sua efetiva aplicação. No tocante à legislação internacional, os documentos analisados são a Declaração dos Direitos das Pessoas Deficientes, a Convenção da Guatemala, a Declaração de Salamanca, a Carta para o terceiro milênio, a Convenção da ONU sobre os direitos das pessoas com deficiência e a Declaração Internacional de Montreal sobre a Inclusão. Já com relação à legislação nacional, merecem destaque a Constituição Federal de 1988; a Lei 9394/96 (Lei de Diretrizes e Bases da Educação Nacional - LDB); além de outras leis, portarias, decretos, resoluções e um aviso circular. Ao final, faz-se uma conclusão, sintetizando os principais pontos observados, inclusive quanto ao excesso de leis existentes sobre acessibilidade e quanto a sua baixa aplicação na prática.
