Abstract
La situation en Libye et, dans une moindre mesure, en Centrafrique et au Yémen, a rouvert le débat sur la faillite de l’État et ses diverses implications en droit international. Issu de la science politique, le concept d’« État en faillite » est généralement utilisé pour décrire la situation d’un État qui se retrouve dans l’incapacité d’assumer ses fonctions régaliennes de base à la suite de l’effondrement total ou partiel de ses institutions gouvernementales et administratives. Le concept reste cependant controversé en droit international. Rejeté par une partie minoritaire de la doctrine, il est l’objet d’interprétations différentes par celle qui l’admet, tant en ce qui concerne son contenu que pour ses implications juridiques. Le présent article se veut une modeste contribution au renouvellement de la réflexion sur le sujet. Il s’insère dans l’effort global de construction d’un statut particulier pour l’État en faillite, statut que l’ancien Secrétaire général des Nations Unies, le regretté Boutros Boutros-Ghali, avait appelé de ses voeux en 1996 au regard notamment des difficultés et des interrogations qu’avait suscitées l’effondrement de l’État somalien.
