Cet article propose une analyse de l’usage par les juges allemands de la connaissance scientifique sur la dangerosité des pesticides et des ondes électromagnétiques. Il va de soi que les juridictions doivent dans tous les cas recourir au savoir scientifique, mais la question est celle de savoir comment établir ce savoir dans le procès. En ce qui concerne les contentieux administratifs, les juges ont tendance à suivre les résultats et évaluations de l’autorité administrative compétente. Au cas où il existe des valeurs limites officielles établies par les autorités administratives spécialisées en la matière, les juridictions, en matière civile ainsi qu’administrative, vont pourtant appliquer ces valeurs. Les expertises judiciaires, par contre, ne sont généralement utilisées que pour confirmer le résultat trouvé par l’autorité administrative compétente ou par l’application des valeurs limites des autorités administratives spécialisées. Si une expertise judiciaire n’est pas en conformité avec ces données, le juge va en général argumenter que l’expertise judiciaire n’est pas convaincante.
