La mutation permanente des applications des technologies sans fil utilisant les radiofréquences s’accompagne de questionnements, aussi bien de la part des usagers qui les utilisent ou qui y sont exposés, que dans la sphère scientifique. Cet article propose d’explorer l’évolution réglementaire qui encadre les technologies sans fil au regard du développement des connaissances liées à l’exposition aux champs électromagnétiques radiofréquences et aux effets sanitaires qui pourraient y être associés. Le cadre réglementaire dans ce domaine peut être vu comme un reflet des connaissances et incertitudes scientifiques, sur lequel se construisent des dispositions héritées de la législation européenne (Directive 1999/5/CE) ou d’application du principe de précaution (Loi n° 2015-136 du 9 février 2015 relative à la sobriété, à la transparence, à l'information et à la concertation en matière d'exposition aux ondes électromagnétiques), par exemple. Même si les controverses publiques autour de la question des effets sanitaires liés à l’exposition aux champs électromagnétiques ne reflètent pas forcément les niveaux de preuve scientifique de leur existence, elles ont poussé à renforcer la structuration et la description des méthodes d’évaluation des risques dans ce domaine. Cet effort permet de mieux faire émerger les types d’incertitude scientifique qui accompagnent les évaluations de risque (manque de connaissances, données contradictoires, etc.) et ainsi affiner les mesures de gestion ou évolutions réglementaires éventuelles.
