Abstract
Emily Murphy a siégé à la Cour des femmes d’Edmonton de 1916 à 1931. Quatre banques de données (dossiers judiciaires, données compilées et envoyées mensuellement au Procureur de la Couronne, articles parus dans l’Edmonton Bulletin et le registre de la Prison de Fort Saskatchewan) permettent de cerner l’originalité de la carrière juridique de Murphy et de mesurer la réception de son action. Ses contemporains l’ont vue comme une femme engagée, un réformateur social qui a cherché à améliorer particulièrement la situation des femmes et des enfants. Ses biographes ont peint sensiblement le même portrait. Si elle croyait fermement qu’en tant que femme elle avait sa place dans l’appareil juridique, et qu’elle laissait entendre que sa nature maternelle changerait l’administration de la justice, son action ne permet pas de tirer une telle conclusion. Murphy a jugé près de 3800 causes au cours de sa carrière. Elle a eu tendance à imposer aux coupables des sentences plus lourdes que celles données par les autres magistrats.
