Abstract
Sous l’impulsion, notamment, d’un certain nombre d’institutions financières canadiennes, mais aussi au vu du contexte national et international de cristallisation des consciences sur les enjeux de la lutte contre la fraude et l’évasion fiscales, le Canada a adopté, en 2014, la Loi de mise en oeuvre de l’Accord Canada–États-Unis pour un meilleur échange de renseignements fiscaux qui a, depuis lors, permis la mise en oeuvre de la loi américaine Foreign Account Tax Compliance Act (FATCA), relative au respect des obligations fiscales concernant les comptes déclarables américains ouverts, au Canada, par des personnes présentant des indices d’américanité. Les premiers échanges de renseignements, qui devaient avoir lieu le 30 septembre 2015, ont été l’élément déclencheur d’une série de contestations judiciaires quelques mois plus tôt, traduisant la double volonté de mettre en cause l’illégalité de ces procédés, y compris de leur assise textuelle, et de contrer l’influence, voire l’extraterritorialité, de la loi FATCA. En témoignent, à juste titre, la procédure judiciaire engagée devant la Cour fédérale du Canada dans l’affaire faisant l’objet du présent commentaire et le jugement qui s’en est suivi.
