A participação dos atores privados na luta contra as mudanças climáticas é um fato bem estabelecido e que é responsável pela produção de uma atividade normativa intensa e diversificada. Essa atividade ocorre principalmente através da elaboração de certas normas climáticas de origem privada e que possuem uma dimensão internacional em razão da desterritorialização de seus âmbitos de aplicação. Esta constatação nos leva a questionar a existência de um possível direito transnacional das mudanças climáticas que se desenvolve à margem do direito nacional e internacional das mudanças climáticas. Com base nas discussões que têm sido realizadas sobre o direito transnacional em outras áreas, este estudo pretende fornecer algumas respostas sobre a possível existência de um direito transnacional das mudanças climáticas.
