Abstract
Cet article propose une mise à l’épreuve des théories de Willem Bonger, d’une part, et de Georg Rusche et Otto Kirchheimer, d’autre part, dans le contexte de la Grande dépression au Canada. Selon Bonger, le système capitaliste serait criminogène. Nous faisons l’hypothèse qu’une forte dépression économique exacerbe son caractère criminogène et causerait une augmentation de la criminalité, notamment l’homicide. Selon Rusche et Kirchheimer, les conditions du châtiment pénal varient en fonction des fluctuations du système capitaliste. Nous faisons l’hypothèse qu’une forte dépression économique exacerbe le caractère punitif de l’Etat et causerait une augmentation de la pénalité, notamment la peine de mort.
