À partir des résultats d’une recherche ethnographique portant sur les implications de la montée en puissance de la question du risque sur les décisions des juges québécois en matière de détention provisoire, cet article propose d’apporter un éclairage sur le fonctionnement concret du processus de cautionnement, sur les logiques décisionnelles qui s’y déploient et contribuent aux tendances à la hausse des placements en détention avant jugement. D’une part, il s’attache à montrer que ces placements relèvent moins d’une décision des juges que des pratiques respectives et croisées du ministère public et de la défense. D’autre part, il met en évidence que cet état de fait est tributaire du cadre dans lequel s’insèrent comparutions et enquêtes sur remise en liberté où les considérations en termes de gestion des flux exacerbent et même, dans certains cas, supplantent celles en termes de gestion des risques. Enfin, si l’existence d’un partage des tâches en matière décisionnelle et celle concomitante d’un mode de régulation des flux de prévenus en amont de l’office du juge sont présentées comme une nécessité fonctionnelle, elles posent néanmoins la question du rôle du juge à l’égard de pratiques dont la contribution à l’inflation du recours à la détention provisoire est certes indirecte mais déterminante.
