المشاكل القانونية التي تواجه تنظيم التكنولوجيا الرقمية ((دراسة تطبيقية على بعض الدول المتطورة))

Abstract
على الرغم من الخطوات الحثيثة الدأوبة لتنظيم عمل التكنولوجيا المرتبطة بالإنترنت و إستخداماتها, يجد الفكر القانوني نفسُه, في الكثير من الأحيان, عاجزاً عن إدراك هذا السبق. فمع بزوغ عصر تكنولوجيا التصوير الرقمي الديجيتال و حلول الطابعات ثلاثية الوظائف ( طابعة, سكانر و فاكس) و مع توافر إمكانية طباعة عدد هائل من الكتب وتوزيعها عبر شبكة الإنترنت بتكلفة بسيطة, سرعان ما حلّت المكتبات الرقمية مكان المكتبات التقليدية. في سعيها لإحتواء هذة الطفرة التكنولوجية و تداعياتها القانونية, لجأت بعض المكتبات, كالمكتبة الوطنية البريطانية, إلى مشاريع مُشتركة مع شركة مايكروسوفت مما مّهد لظهور أول نت بوك في العالم (Netbook). أدى هذا التطور التقني إلى ظهور برامج و تطبيقات تُساعد مُستخدمي الإنترنت على تبادل الملفات بشكل بسيط فعال و مجاني. لاستثمار هذة الظاهرة, عمدت بعض الشركات إلى تطوير برامج حاسوب تُمكن المستخدمين من تبادل المعلومات بشكل جماعي. للترويج لتلك البرامج, قامت الشركات المُصممة لتلك البرمجيات بطرحها مجاناً في الإنترنت. أثار هذا التصرف حفيظة الكثير من المؤسسات و الافراد على اعتبار أن طرح تلك البرمجيات يُشجع, و إن يكن بشكل غير مباشر, على النسخ و التقليد. لم يمض وقت طويل حتى ظهر مفهوم أكثر تعقيداً و إرباكاً لقوانين حماية الملكية الفكرية عبر العالم و هو مفهوم الحياة الإفتراضية ( Avatar). ضمن هذا المفهوم, يعيش الأشخاص ضمن إطار عالم وهمي افتراضي مغلق و غير متاح لمستخدمي الإنترنت الطبيعيين. يُوفر هذا العالم لروادة إمكانية تقمص أي شخصية اعتبارية أو طبيعية أو وهمية و كذلك الحق في تمّلك عقارات, براءات اختراع, علامات تجارية أو افتتاح شركات وهمية بأسماء حقيقية كاسامسونغ أو مرسيدس مما أثار قلق المشّرعين و أصحاب حقوق الملكية الفكرية على حدٍ سواء. تُقدم هذة المقالة مُقاربة قانونية للإشكاليات المتعلقة بتلك المفاهيم من الناحية الدولية مع التركيز على مفهوم المكتبات الرقمية و قواعد البيانات التفاعلية لجهة الفوائد التي تُقدمها و التحديات التي تفرضُها. كذلك تبّين هذة المقالة دور القضاء في معالجة تلك التحديات القانونية من خلال عرض بعض الدعاوى ذات الصلة مع التركيز, و إن يكن بشكل غير حصري, على الموقف القانوني الإنكلوسكسوني. على أن يتم التعرض لموقف المشرع السوري, إن وجد, من تلك القضايا. خُلصت هذة المقالة إلى نتيجة مفادها ضرورة تعاطي القانون مع تلك الظواهر بشكل يسمح باستمرار التحديث و الإبداع في هذا المجال الحيوي و بالتالي عدم استخدام قانون حماية الملكية الفكرية كعائق يحول دون تطور التكنولوجيا و نموها. This Article addresses the interaction between digital technology and Intellectual Property Law. Despite its obvious benefits, the Internet was and still is a major source of legal obscurity. The one million dollar question is to what extent, if at all, can the law of intellectual property strike the correct balance between innovation and the protection of Intellecual Property Rights? Keeping the concepts of digital liabraries, peer 2 peer systems and second life, answering the previous questions seems to be easirer said than done. Keeping the above in mind, this Article highlights the legal argument in the United States of America, Canada and the UK. As such, it does focus, unexclusivily, on the Common Law System. The conclusion we have reached is that any answer could be anticipated to deal with these technological issues from a legal point of view should not be taken as an excuse to hinder the development of business.
