Abstract
Une affaire qui touche essentiellement à l’application de la règle dite de l’épuisement des voies de recours internes et à la procédure devant la Cour de Cassation française, mais apporte surtout un éclairage sur le rôle que la Cour européenne des droits de l’Homme entend jouer par rapport aux juridictions nationales et, en particulier, aux juridictions suprêmes. C’est là un des principaux apports de cette décision. Tout d’abord, elle ne veut en aucun cas constituer un quatrième degré de juridiction et se substituer aux cours suprêmes. Ensuite, elle indique ce qu’elle estime devoir être le rôle de ces juridictions. Elle adresse donc, en quelque sorte, un message aux juridictions suprêmes leur confirmant qu’elle n’entend pas se substituer à elles dans le cadre de la mission qu’elles remplissent au plan interne, à condition qu’elles l’exercent effectivement et dans le respect de la Convention européenne des droits de l’Homme.
