Nach den Entscheidungen "Viking" und "Laval" vom Dezember 2007 hat der EuGH erneut eine heftig umstrittene Entscheidung gefällt, die das Verhältnis grenzüberschreitender Mindestentgelte zu den Grundfreiheiten behandelt. Es handelt sich um die Entscheidung "Rüffert" über die Gemeinschaftsrechtswidrigkeit der niedersächsischen Tariftreueerklärung. Sie zeigt anhand eines Falls aus Deutschland auf, dass es nicht ausreicht, die Kollektivverhandlungsfreiheit als soziales Grundrecht anzuerkennen; um ihr praktische Wirksamkeit zu verleihen, bedarf es einer intensiveren dogmatischen Auseinandersetzung als der EuGH sie bislang zu leisten bereit gewesen is.
