Abstract
The extension to the disciplinary power of the Public Administrations of the principles related to the sanctioning power and the sanctioning administrative procedure contained in Law 30/1992, of November 26, was expressly excluded by the aforementioned Legal Body, which has been repealed, after More than a quarter of a century of validity, from the entry into force of Laws 39 and 40/2015, of 1 October. This new dual regulation of the legal regime of public bodies and the common administrative procedure has included in its scope the exercise of the disciplinary power of the Administration with the personnel at its service, a circumstance that will oblige the competent institutions and bodies, As well as to the different legal operators to make the necessary adjustments to comply with this new regulation, starting with respect for the principle of legality in its formal and material aspects.
