Secondo la Corte di giustizia (UE), la Convenzione di Montreal del 1999 sul trasporto aereo internazionale, nel caso di ritardo nel trasporto di passeggeri, è applicabile non solo al danno subito da un passeggero, ma anche a quello subito dalla persona che, nella sua qualità di datore di lavoro, ha concluso con un vettore aereo il contratto di trasporto internazionale diretto a fare trasportare passeggeri che sono suoi dipendenti. Il contributo sottopone a revisione critica tale conclusione che appare poter avere significativa incidenza in relazione a temi di carattere generale quali: a) l'individuazione del creditore della prestazione di trasporto di persone quando non sia il passeggero a concludere materialmente il contratto, b) l'individuazione del soggetto legittimato a proporre l'azione di responsabilità per inadempimento della prestazione; c) la natura dell'azione risarcitoria promossa da colui che acquista il biglietto pur non essendo passeggero.
