L’accès au droit du travail des étrangers en situation irrégulière en Espagne

Abstract
En se plaçant dans une perspective juridique, l’article analyse le cadre normatif applicable aux travailleurs en situation irrégulière en Espagne au prisme du droit du travail. Dans un premier temps, il aborde la manière dont le droit espagnol règlemente le rapport contractuel existant entre un employeur et un travailleur en situation irrégulière et la reconnaissance des droits liés à la prestation de travail. Ensuite, il vise à établir si les salariés en question ont accès à la liberté syndicale et au droit de grève, ainsi que la portée de ces droits à la lumière de la jurisprudence du Tribunal constitutionnel. Enfin, l’article formule des réflexions critiques relatives à l’état actuel du droit espagnol sur la question, ainsi que sur ses effets possibles sur l’embauche de travailleurs étrangers en situation irrégulière.
