La maternité de substitution constitue un défi majeur pour le législateur, tant il suscite des passions de tous ordres. En France comme au Québec, l’idée même d’un encadrement juridique de cette pratique est loin d’être consensuelle. La présente étude propose une réflexion singulière sur ses enjeux complexes, à l’aune de la théorie générale du contrat. L’idée est de questionner la rationalité des comportements des « agents » en cause (mère porteuse et parents intentionnels) à la lumière des principes directeurs du droit des contrats, pour tenter de montrer que les dimensions juridiques et éthiques sont indissociables non seulement dans la compréhension mais aussi dans l’encadrement nécessaire de cette pratique.
