Abstract
The appointment of the Head of State is, without a doubt, an important and unavoidable step that must be carried out after the elections. This is even more relevant when you consider the limitations of the government in terms of its temporary nature. However, in Spain, the Government extended its period throughout almost all of 2016 since the lack of consensus among political parties and the repetition of the elections prevented the appointment of the president and the formation of the Government. It is precisely this reason what leads to the examination of how the process for the appointment of the president of the Spanish State works
