Abstract
Le placement d’enfants ou de jeunes atteints de troubles psychiatriques est régi par plusieurs instruments juridiques. En plus d’être abordé par les lois portant sur la protection des droits de la personne, les lois provinciales en matière de santé mentale prévoit des mécanismes de placement non-volontaire d’individus atteints de troubles mentaux et présentant un danger pour eux-mêmes ou pour autrui. Quand est-il lorsque l’individu est un enfant ou un jeune? Cette note de réflexion portera sur le régime particulier mis en place en Ontario, où les questions de placement d’enfants ou de jeunes en centre psychiatrique sont régies par la Loi sur les services à l’enfance et à la famille, mettant ainsi l’intérêt supérieur de l’enfant au coeur des décisions judiciaires.
